Terms of Service

These terms are an agreement between you and Cyrcadias, LLC, doing business as My Circadian Health ("My Circadian Health", "we", "us") and govern your use of mycircadianhealth.com, my.mycircadianhealth.com, and the consultation service we sell (together, the "Service"). By using the Service you agree to these terms. If you do not agree, do not use the Service.

If you are in crisis

The Service is not for emergencies. If you are having a medical emergency, call 911. If you are thinking about harming yourself, call or text 988 to reach the Suicide and Crisis Lifeline, available 24 hours a day.

What My Circadian Health is and is not

My Circadian Health operates the Site, sells consultations, and connects you with independent licensed clinicians through a telehealth platform. My Circadian Health does not practice medicine, does not employ the clinicians, and does not control their medical judgment. Your clinician decides whether treatment is appropriate for you. Purchasing a consultation does not guarantee a prescription or any particular outcome. You enter into a clinician-patient relationship with your clinician, not with My Circadian Health, and you will be asked to agree to a separate telehealth consent before your assessment.

Eligibility

You must be at least 18, located in the United States in a state where the Service is available, and able to form a binding contract. You must provide accurate information about yourself, including your legal name, date of birth, and health history. Giving false information can lead to unsafe treatment and ends your right to use the Service.

Your account

An account is created for you on my.mycircadianhealth.com when you purchase a consultation. You are responsible for keeping your password confidential and for everything that happens under your account. Tell us immediately at [email protected] if you believe your account has been accessed without permission.

Fees and payment

The consultation fee is shown at checkout before you pay. It is charged in full when you place your order and is processed by Stripe. The fee covers the clinician's review of your assessment and follow-up messaging about that assessment. It does not include the cost of any medication, which is billed separately by your pharmacy. Prices may change, but a change never affects an order you have already placed.

Refunds

If a clinician has not yet begun reviewing your assessment, you may cancel for a full refund by emailing [email protected]. Once a clinician has reviewed your assessment the fee is earned and is not refundable, whether or not treatment is prescribed. If something goes wrong with the Service itself, contact us and we will make it right.

Prescriptions and pharmacies

Any prescription is written by your clinician at their sole discretion and is sent to the pharmacy you choose. My Circadian Health does not dispense medication and is not responsible for pharmacy pricing, availability, or fulfilment. Take medication only as directed by your clinician and read the information your pharmacy provides.

Articles and information

Articles and other content on the Site are general information, not medical advice, and reading them does not create a clinician-patient relationship. Do not rely on them in place of advice from a licensed clinician who knows your situation.

Acceptable use

You agree not to use the Service for anyone other than yourself, to obtain medication for someone else or for resale, to interfere with the Site's operation, to access it by automated means without our written permission, or to violate any law. We may suspend or end your access if you break these terms.

Intellectual property

The Site, its design, text, graphics, and the My Circadian Health name and logo belong to My Circadian Health or its licensors. You may view and print pages for personal, non-commercial use. Any other use needs our written permission.

Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, My Circadian Health disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement. My Circadian Health does not warrant that the Site will be uninterrupted or error-free, and makes no warranty about the medical care provided by independent clinicians.

Limitation of liability

To the fullest extent permitted by law, My Circadian Health and its owners, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising from your use of the Service. Our total liability to you for any claim arising from the Service is limited to the amount you paid us in the twelve months before the claim. Some states do not allow these limitations, so they may not apply to you. Nothing in these terms limits the professional liability of your clinician.

Indemnification

You agree to defend and hold harmless My Circadian Health from claims, losses, and expenses, including reasonable legal fees, arising from your breach of these terms or your misuse of the Service.

Disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us at [email protected] and give us 30 days to try to resolve it informally. Any claim that is not resolved will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction.

Changes

We may update these terms. When we do, we will change the effective date above and, for material changes, notify account holders by email. Continuing to use the Service after a change means you accept the new terms.
